ProScope Solar Terms of Use

These Terms of Use (“Terms”) govern your use of the ProScope Solar app for iPhone, iPad, and Mac (“Solar” or the “App”) provided by ProScope USA (“ProScope,” “we,” or “us”). By downloading, accessing, or using Solar, you agree to these Terms. If you do not agree, do not use the App.

1. What Solar is

Solar is a companion monitoring app. It displays energy and related telemetry from systems that already use third-party services—primarily EnerWise (inverter / plant cloud) and, optionally, Eco-Worthy (battery / BMS).

Solar:

  • reads cloud and/or BMS data for display and local charts;
  • does not replace the EnerWise or Eco-Worthy apps;
  • does not control inverter settings, battery charging policy, grid export, relays, or other hardware functions;
  • is not an official product of EnerWise, Eco-Worthy, or your inverter manufacturer unless we expressly say otherwise.

2. Eligibility and accounts

You must be able to form a binding contract and must comply with Apple’s App Store rules and applicable law.

To use live plant monitoring you generally need a valid EnerWise account for a plant you are authorized to access. Optional Eco-Worthy features require an Eco-Worthy account and/or nearby Bluetooth access to a compatible BMS, depending on the feature you use.

You are responsible for:

  • keeping your credentials and devices secure;
  • ensuring you have the right to access any plant or battery data you connect;
  • all activity that occurs through sessions you import or sign into on your device.

3. Demo mode

Demo mode shows synthetic plant data so you can explore the interface without vendor accounts. Demo data is not your real system and must not be relied on for decisions about a live plant.

4. Subscriptions, trial, and billing

Solar may offer a free trial and/or a paid auto-renewable subscription for live monitoring features. Pricing, trial length, and renewals are shown in the App and/or App Store at purchase time.

  • Payment is charged to your Apple ID through Apple’s In-App Purchase system.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period (or as otherwise required by Apple / local law).
  • Manage or cancel in your Apple ID subscription settings.
  • Demo mode may remain available without a paid subscription.
  • Refunds, if any, are handled by Apple under Apple’s policies, except where local law requires otherwise.

We may change prices or subscription offerings prospectively as allowed by Apple and applicable law.

5. Acceptable use

You agree not to:

  • misuse Solar or attempt to disrupt it or related services;
  • reverse engineer the App except where applicable law expressly allows;
  • use Solar to access plants, accounts, or devices without authorization;
  • rely on Solar as the sole safety, fire, life-support, or critical-control system for any installation;
  • use Solar in violation of law, these Terms, or third-party terms that apply to EnerWise, Eco-Worthy, Apple, or your equipment.

6. Third-party services and hardware

Solar depends on third parties that we do not control, including EnerWise, Eco-Worthy, Apple, your internet connection, and your inverter/battery hardware.

Those parties may change APIs, rate limits, authentication, data fields, availability, or accuracy at any time. As a result, Solar features may be delayed, incomplete, inaccurate, rate-limited, or unavailable.

Your use of EnerWise, Eco-Worthy, Apple, and your equipment remains subject to those parties’ terms and privacy policies.

7. Data accuracy and no professional advice

Dashboard values, charts, energy totals, flow graphics, and BMS readings are estimates or displays based on available telemetry and local calculations. They may differ from vendor apps, utility meters, invoices, or actual physical conditions.

Solar is for informational monitoring only. It is not professional electrical, engineering, safety, or financial advice. Do not make high-stakes decisions (including safety, export limits, warranty, or billing disputes) based solely on Solar.

8. Local data

Chart archives and energy totals may be stored on each device separately. Clearing app data, switching devices, or using Demo incorrectly on older builds can affect local totals. Features such as rebuilding archives from cloud history may be available in Settings when supported.

9. Intellectual property

Solar, including its design, text, graphics, and software, is owned by ProScope or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the App to you. You receive a limited, non-exclusive, non-transferable, revocable license to use Solar for personal or internal business monitoring on devices you own or control, subject to these Terms and the App Store rules.

EnerWise, Eco-Worthy, and other brand names are trademarks of their respective owners.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLAR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SOLAR WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROSCOPE AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF SOLAR, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO SOLAR WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SOLAR SUBSCRIPTION ACCESS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $25.

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the fullest extent permitted.

13. Indemnity

To the maximum extent permitted by law, you agree to defend and indemnify ProScope against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of Solar, your unauthorized access to third-party accounts or plants, or your violation of these Terms.

14. Changes and availability

We may update Solar and these Terms from time to time. Material changes to the Terms will be reflected by updating the “Last updated” date and/or posting a notice in the App or on our website. Continued use after changes means you accept the updated Terms.

We may modify, suspend, or discontinue features (including free trial terms) at any time, including when third-party APIs change.

15. Termination

You may stop using Solar at any time and may delete the App. We may suspend or terminate access if you violate these Terms or if continued operation is impractical (for example, because a required third-party service changes or ends). Provisions that by nature should survive will survive termination.

16. Apple-required terms

You acknowledge that these Terms are between you and ProScope only, not Apple. Apple is not responsible for Solar or its content. Apple has no obligation to provide maintenance or support for Solar. To the extent any warranty is not effectively disclaimed, Apple’s responsibility is limited as stated in Apple’s App Store terms. Apple is not responsible for addressing claims relating to Solar (including product liability, legal/regulatory claims, consumer protection claims, or intellectual property infringement claims). You and ProScope acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you regarding your license to use Solar on Apple platforms.

17. Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise. Courts in California will have exclusive jurisdiction, except where mandatory law gives you the right to bring claims in your local courts.
